On October 6, 2021, the BLM is upholding the Pueblo of Acoma’s protest on the grounds that the BLM failed to provide adequate and meaningful Tribal consultation. The BLM must make a good faith effort to conduct meaningful consultation with tribes in compliance with the various laws, policy and regulations (e.g. National Historic Preservation Act 54 U.S.C. Section 306108 (commonly referred to as Section 106) and its implementing regulations found at 36 CFR 800, National Environmental Policy Act (NEPA), American Indian Religious Freedom Act (AIRFA), and Executive Order 13007). With respect to the December 2019 Lease Sale, although the Tribe requested Tribal consultation as early as September 27, 2019, the BLM Monticello Field Office did not respond to that request until December 11, 2019, one day after the Lease Sale took place. Therefore, the BLM has determined that it did not provide adequate consultation for the December 2019 Lease Sale.  As a result, the issuance of the leases would not be lawful under applicable law. 


On November 21, 2019, the BLM received the Advisory Council on Historic Preservation's concurrence with the no adverse effect. 

PROTEST PERIOD: The protest period ended on November 25, 2019. The BLM received 4 protest letters from Southern Utah Wilderness Alliance (SUWA), Friends of Cedar Mesa, Pueblo of Acoma, and WildEarth Guardians.
