Project Description:
Garfield County is the holder of an Revised Statute (R.S.) 2477 right-of-way (ROW) for the Burr Trail, which crosses BLM-administered federal public lands located in Garfield County, Utah. The County has advised BLM that it wants to chip seal a currently graveled 7.5-mile segment of the Burr Trail beginning to the east of Capitol Reef National Park and running in a southerly direction to the intersection with the Stratton Road. Pursuant to Tenth Circuit case law and Instruction Memorandum (IM 2008-175), BLM needs to complete the consultation process on the proposed project because chip-sealing a hard-packed dirt or gravel R.S. 2477 ROW is an improvement to the ROW. In the consultation process, BLM must first assess whether the proposed improvement is reasonable and necessary and, thus, within the scope of the ROW. If BLM determines that the proposed improvement is within the scope of the ROW, it must next assess whether the proposed improvement may adversely affect the surrounding public lands or resources and, if so, whether there are alternatives or modifications to the proposed improvement that would avoid or minimize such impacts. BLM has determined that the proposed improvement is within the scope of the County’s ROW. BLM has prepared Environmental Assessment DOI-BLM-UT-C020-2019-0006-EA to consider whether the proposed improvement may adversely affect the surrounding public lands or resources and, if so, whether there are alternatives or modifications to the proposed improvement that would avoid or minimize such impacts. The EA will be available for public review and comment from April 1, 2019 to April 15, 2019.
