The Bureau of Land Management (BLM), Sierra Front Field Office has prepared the American Flat Road/Lucerne Access Right-of-Way Amendment, Revised Draft Environmental Assessment. The Revised Draft Environmental Assessment (EA) analyzes the direct, indirect and cumulative effects from a right-of-way amendment that would be issued to Comstock Mining, LLC. This analysis has been prepared to comply with the National Environmental Policy Act and National Historic Preservation Act.
In August 2012, Comstock Mining, LLC. submitted to the BLM a draft Plan of Development (see Documents) and application to amend their existing right-of-way (ROW) (NVN-091237) for the use of the American Flat Road. Their existing ROW would expire on December 31, 2017.
The Revised Draft EA analyzes the following activities:
Modifications to the American Flat Road (see Maps) to facilitate safe use of the roadway;
Realignment of a portion of the American Flat Road to segregate public traffic from haul traffic; and
Use of several "wedges" of public land in the Lucerne Pit for haul-through purposes.
The Lucerne Haul Road would be used exclusively for haul-through purposes.
The BLM and consulting parties have also prepared a draft Memorandum of Agreement (MOA) under the National Historic Preservation Act to resolve potential adverse effects to eight historic properties in the project area (see Documents).
The public review and comment period ended on October 20, 2015.
