Appeal Period
On September 4, 2019, Protest to the inclusion of parcels in the March 2019 Oil and Gas Lease Sale have been resolved.  This initiates a 30-day appeal period

January 30, 2019 - In keeping with the Administration’s goal of promoting American energy independence, the Bureau of Land Management is issuing an Notice of Competitive Lease Sale (NCLS) intending to offer 156 parcels, totaling nearly 217,576 acres in lands managed by the Canyon Country, Green River, and West Desert Districts at its March 25-26, 2019 quarterly oil and gas lease sale. "The purpose of the sale notice is to identify parcels by number, describe the lands...indicate the parcel acreage...set forth lease stipulations" etc.  (Federal Register Vol 53, No. 54, 9218).

The NCLS is posted on the "Documents" page of this project site.   Posting the NCLS  for the March 2018 Lease Sale initiates a 30 day public protest period which runs from January 30 until March 1, 2019.   Protests can be incorporated into one document for the entire state, if parcels are protested from multiple BLM districts and considered in multiple National Environmental Policy Act (NEPA) compliance documents, or in separate protests of one or more parcels considered in single NEPA compliance documents. Lack of specificity of which parcel(s) the protester believes applies to each protest point may result in summary dismissal of the protest point, or the entire protest.  Providing a list of parcels in the beginning of the protest may not be sufficient since BLM will not make assumptions about which parcels apply to each protest point. The BLM may suspend (defer) specific parcels if a protest contention warrants, however, although 43 C.F.R. § 3120.1-3  allows the authorized officer to "suspend the offering of a specific parcel while considering a protest or appeal against its inclusion in" an NCLS, only the Assistant Secretary for Land and Minerals Management may suspend an entire "lease sale for good and just cause after reviewing the reason(s) for an appeal." 

The protest period ends at 4:30 p.m. MST on March 1, 2019.  In accordance with the BLM 3120 Competitive Leases Handbook, protests must be received by that date and time, either faxed to Sheri Wysong at (801) 539-4237 or submitted in hardcopy form by mail or hand delivery to the BLM Utah State Office, 440 West 200 South, Suite 500, Salt Lake City, UT 84101.
